I. GENERAL PROVISIONS

  1. These Terms and Conditions set out the rules for the provision of services by electronic means by the Robert Dobrzycki Foundation, with its registered office in Warsaw (address: Rondo Daszyńskiego 1, 00-843 Warsaw), entered into the register of associations, other social and professional organisations, foundations and independent public healthcare institutions of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register, under KRS number 0001092803, holding NIP (tax identification number) 5273103351 (hereinafter: the “Foundation” or the “Service Provider”).
  2. These Terms and Conditions set out:
    1. the type and scope of services provided by electronic means,
    2. the conditions for using the Foundation’s website,
    3. the rules for concluding and terminating agreements for the provision of services by electronic means,
    4. the procedure for lodging and handling complaints.
  3. Using the Foundation’s website constitutes acceptance of these Terms and Conditions.
  4. These Terms and Conditions are made available free of charge in a manner that allows them to be obtained, reproduced and recorded, at: https://rdfoundation.org/.

 

II. DEFINITIONS

For the purposes of these Terms and Conditions, the terms used herein have the following meanings:

  1. Website – the online service operated at https://rdfoundation.org/.
  2. Services – services provided by electronic means via the Website, consisting, among other things, in making available content, contact forms, newsletter sign-ups and other functionalities.
  3. Service Recipient – any natural person, legal person or organisational unit using the Website.
  4. Newsletter – a service consisting in sending, by electronic means, information related to the Foundation’s activities (where this function is available).
  5. Contact form – the form made available on the Website by means of which the Service Recipient may send an enquiry or message to the Foundation.
  6. Online donation – an electronic form of making a donation to the Foundation, where such an option is available on the Website.
  7. Terms and Conditions – these Terms and Conditions for the provision of services by electronic means.

 

III. TYPE AND SCOPE OF SERVICES PROVIDED

  1. The Service Provider provides the following services by electronic means:
    1. making available informational content concerning the Foundation’s activities (mission, objectives, projects, news) – without the need to register,
    2. the Newsletter service, where available,
    3. the Contact form,
    4. other electronic services available on the Website.
  2. The Services are provided free of charge, unless the content of the Website provides otherwise.
  3. Using the Website requires:
    • having a device with access to the Internet,
    • having an active e-mail address (in the case of using the Contact form or the Newsletter),
    • using an up-to-date version of a web browser.

 

IV. CONCLUSION AND TERMINATION OF THE AGREEMENT

  1. The agreement for the provision of services by electronic means is concluded upon commencing the use of the specified services on the Website.
  2. The agreement relating to the Newsletter is concluded upon correct sign-up and confirmation of the subscription (where this function is active).
  3. The agreement relating to the Contact form is concluded upon sending a message via the form.
  4. The agreement may be terminated by the Service Recipient at any time by ceasing to use the services or, in the case of the newsletter, by unsubscribing.

 

V. RIGHTS AND OBLIGATIONS OF THE PARTIES

  1. The Foundation makes every effort to ensure the proper and uninterrupted operation of the Website, subject to the possibility of technical breaks occurring.
  2. The Service Recipient is obliged to use the Website:
    • in accordance with applicable law,
    • in accordance with the principles of social coexistence and good practice,
    • in a manner that does not infringe the rights of third parties.
  3. It is prohibited to provide content of an unlawful nature, in particular content that:
    • infringes personal rights,
    • is contrary to applicable legal provisions,
    • contains offensive or misleading content.
  4. The Foundation is not liable for content posted on the websites of third parties to which links posted on the Website lead.

 

VI. COMPLAINTS

  1. The Service Recipient has the right to lodge a complaint concerning the provision of services by electronic means.
  2. A complaint should be sent by electronic means to: [email protected] (contact address obtained from the Foundation’s Website).
  3. A complaint should contain the Service Recipient’s contact details and a description of the reservations or irregularities raised.
  4. The Foundation will consider the complaint within 14 days of its receipt and will provide a response by electronic means.

 

VII. LIABILITY

  1. The Foundation is not liable for:
    1. interruptions in the operation of the Website resulting from technical or maintenance reasons or reasons beyond the Foundation’s control,
    2. damage resulting from the Service Recipient’s improper use of the Website,
    3. the consequences of the Service Recipient’s use of links leading to external services.
  2. The Foundation’s liability towards the Service Recipient is limited to the extent arising from mandatory provisions of law.

 

VIII. PROTECTION OF PERSONAL DATA

  1. The rules for the processing of personal data by the Foundation are set out in a separate Privacy Policy, available on the Website.
  2. Personal data is processed in accordance with applicable provisions, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).

 

IX. AMENDMENTS TO THE TERMS AND CONDITIONS

  1. The Foundation reserves the right to amend these Terms and Conditions for important reasons, in particular in the event of:
    • changes in legal provisions,
    • changes in the scope of the Services provided,
    • technical or organisational changes.
  2. The current text of the Terms and Conditions will be published on the Website in each case.

 

X. FINAL PROVISIONS

  1. In matters not regulated herein, the provisions of generally applicable Polish law shall apply.
  2. These Terms and Conditions enter into force on the date of their publication on the Website.
